I, understand that in conjunction with my application for employment or personal background screening an investigative report may be generated on me that may include information as to my character, work habits, performance and experience, along with reasons for termination of past employment, financial/credit history, criminal history records from any criminal justice agency in any or all federal, state, city and county jurisdictions, state Department of Motor Vehicle/Drivers' License Records to include traffic citations and registration, military records from the National Personnel Record Center, education records including transcripts and GPA, and requests for records and information from any individual, company, firm corporation, present and/or past employers and public agencies (including the Social Security Administration and U.S. Citizenship and Immigration Services).
I fully understand that Binary Biometrics and/or their agents, may be requesting information from public and private sources about any of the information noted earlier in this paragraph, and I freely give my consent for Binary Biometrics and/or its agents to do so.
I agree that a photocopy or telephonic facsimile of this authorization shall be valid as the original with the same authority as the original and I specifically waive any written notice from any present or former employer who may provide information based upon this authorized request.
I hereby authorize, without reservation, anyone contacted by Binary Biometrics and/or their agents, to furnish the information described in Section 1. Information may be released to Binary Biometrics and/or their agents, by telephonic facsimile or email.
I hereby authorize, without reservation, Binary Biometrics and/or their agents, to contact my former employer/employers for employment verification/references.
I hereby release Binary Biometrics and its agents and all persons, agencies, and entities providing information or reports about me, from any liability arising out of the request for or release of any of the above-mentioned information or reports. This disclosure further serves as a request that any present or former employer, police department, educational or financial institution or other person having personal knowledge about me to furnish Binary Biometrics, its agents and its affiliates or representatives any and all information in their possession regarding me in connection with my application for employment or personal background screening. IN NO EVENT SHALL BINARY BIOMETRICS, ITS AFFILIATES OR ANY OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR CONTENT OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE, THE SITE OR THE CONTENT, MATERIALS AND FUNCTION RELATED THERETO, INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, OR ANTICIPATED PROFITS, OR LOST BUSINESS, DATA OR SALES, OR COST OF SUBSTITUTE SERVICES, EVEN IF BINARY BIOMETRICS OR ITS REPRESENTATIVE OR SUCH INDIVIDUAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL THE TOTAL LIABILITY OF BINARY BIOMETRICS TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR OTHERWISE) ARISING FROM THE TERMS OF YOUR USE OF THESE SITES EXCEED, IN THE AGGREGATE, $100.00.
